Effect of TPPA on Malaysian business firm

THE Trans-Pacific Partnership Agreement (TPPA) negotiations have concluded and citizens of all 12 participating countries will be seeking clarity on how their respective nations will benefit from this historic agreement.
It is important to recognise that in an increasingly globalised world, we will see more nations working towards trade liberalisation, free markets that will ultimately benefit the participating nations. The 12 TPPA members make up 40% of global GDP and approximately a third of world trade – collectively representing a population in excess of 750 million people.
By reducing trade barriers, TPPA will provide Malaysian-owned businesses wider access to international markets and it will strengthen the country’s economic growth. The recently negotiated agreement will provide local businesses with the first ever Free-Trade Agreements between Malaysia and the US, Canada, Mexico and Peru, in addition to enhancing access to eight other markets.
Some of the sectors that will benefit quickly in Malaysia are textiles, apparel, commodities and the electronics industry.
According to the HSBC Small Business Confidence Monitor Survey, 42% of Malaysian small and medium-sized enterprises (SMEs) are involved in cross-border and international trade. Most SMEs establish themselves within the domestic market and then seek opportunities to expand their footprint across the region. With TPPA, Malaysian SMEs will have accelerated growth opportunities as the multilateral trade agreement will enable improved uniformity for selected regulations and harmonised standards in several areas.
Currently, Malaysia is the third largest recipient of foreign direct investment (FDI) in Asean and TPPA provides Malaysia a competitive edge among Asean countries to spur further investment.
There are concerns that the Investor State Dispute Settlement (ISDS) mechanism overpowers Malaysian laws but ISDS is not something new to Malaysia. It simply provides investors a level of assurance that affected parties have an avenue for recourse.
In fact, since 1963 Malaysia has signed and ratified 64 Investment Guarantee Agreements (IGAs) with countries including the US, Canada and Mexico, all of which have provisions on ISDS.
Amcham believes that enhanced protection for patents will strengthen Malaysia’s appeal as a destination for high-tech manufacturing, drive foreign investment and create jobs. The intellectual property rights (IPR) chapter calls for a level of protection on design, trademarks and patents across geographical boundaries, which in turn encourages Malaysian companies to embark on further research and development. This promotes an environment that recognises the societal benefit of innovation.
Pharmaceutical research and development leads to the discovery of future life-changing and life-saving medicines. After patents expire, generic versions of innovative drugs continue to be widely used for decades, generating enormous health benefits for consumers. Malaysia stands to benefit through increased investment from multinational companies in the areas of research and development and clinical trials, potentially helping to build a local industrial base, and encourage the entry of more innovative products to the domestic market.
The issue of government procurement has also been raised during negotiation. According to the World Trade Organisation, government procurement accounts for some 15% to 20% of GDP on average in TPPA-related countries. Many TPPA partner countries, including the United States, have government procurement set asides in their respective countries.
With the TPPA, Malaysian-owned businesses will have opportunities to participate in government procurement in TPPA member countries. This promotes competitive neutrality and a level playing field among TPPA members. We foresee that the final text of the TPPA will have some level of appropriate discretion for procurement with participating governments.
Malaysia has established strong foundations in technology, e-commerce and financial services. Together with the removal of digital customs duties, localisation barriers and forced technology transfers, these benefits of TPPA will boost Malaysia’s vision of becoming an e-commerce and high-tech hub within the region. These steps will catalyse the efforts of Malaysian SME’s to better participate in the global marketplace.
Likewise, easing of limitations on foreign firms’ participation in the financial sector empower Malaysian banks in TPPA markets as they expand and seek opportunities in the region and beyond.
The TPPA is a historic multi-lateral trade agreement and a significant milestone to US-Malaysia relations benefitting both nations and creating a wealth of opportunities for business and citizens of both countries.

I Synergy Universal Sdn Bhd, the company that developed and manages Affiliate Junction (AJ), has intensified its focus on increasing retail revenue among its 9,000 AJ affiliates and over 700 merchants, as well as expanding abroad.
“In the first two growth phases of the firm, we focused more on establishing the company’s set-up as well as building the affiliate network with a strong base of affiliates.
“Having accomplished both, we are moving into the next phase of encouraging a more dynamic and high transaction ecosystem for our merchants and affiliates,” said IS Group of Companies Group CEO Datuk Lawrence Teo during the AJ Phase 3 soft launch held at Putrajaya International Convention Centre recently.
MyKad Smart Shopper Programme (MSSP), the anchor affiliate programme under AJ, is a multi-merchant retail affiliate programme that uses the MyKad as members’ identification, where members can get membership privileges, while AJ Affiliates who refer these members to the merchants are rewarded through the programme’s system.
Under its third phase developments, AJ is introducing significant technology enhancements to further enrich the delivery of MSSP to its network of affiliates, merchants and MSSP members.
Merchants can also leverage the convenient use of wireless electronic data capture (EDC) terminals instead of desktop computers.
These MSSP terminals are programmed with proprietary MSSP functions to securely capture member retail transactions and facilitate redemptions.
A new incentive mechanism is also introduced to help boost volume of members’ retail transactions with merchants, increasing their sales.
Besides the reward points that can be used to redeem merchandises from AJ, MSSP members can earn cash points with purchases that can be accumulated and subsequently used to redeem goods and services of any participating merchants.
Other enhancements to the system include introducing online referral links and QR codes to speed up the MSSP member activation process, enabling consumers to self-register on the MSSP Portal online just by clicking on the referral links or scanning QR codes given to them by AJ Affiliates.
“We are confident these enhancements can help boost retail revenue for our existing network of affiliates and merchants as well as drive stronger participation for others to join our programme.
“As an added incentive for merchants to come on board MSSP, we are waiving the RM2,550 joining fee for the first 1,000 merchants who sign up for the programme,” said Teo.
He is optimistic the new developments and activities in AJ’s third phase would help the network attract more retail merchants to participate in its affiliate programmes and ultimately drive at least tenfold increase in merchant transactions by the end of this phase of business growth.
During the soft launch, the company also announced their expansion into Indonesia, in addition to increasing its corporate social responsibility (CSR) initiatives focusing on helping the needy and the environment through collaborations with various bodies.

Tan Sri Lim Goh Tong


        Tan Sri Lim Goh Tong (February 28, 1918 – October 23, 2007) was a prominent wealthy Malaysian Chinese businessman. He was renowned for his vision and courage in transforming Genting Highlands from an unexplored hilltop to one of the world's most successful casino resorts. He was once the 3rd richest man in Malaysia with a net worth estimated to be 4.2 billion USD, making him the 204th richest person in the billionaire list compiled by Forbes.
           The idea of developing Genting Highlands was first conceived when Lim Goh Tong was having a dinner in Cameron Highlands. An idea struck him when he was enjoying the soothing cool breeze of Cameron Highlands that as the living standard rose in Malaysia, more and more people would visit mountain resorts for relaxation and recreation, but Cameron Highlands was too far away from the capital city Kuala Lumpur, therefore building a mountain resort nearer to Kuala Lumpur would have great business potential.
          Upon conceiving this idea, many people were skeptical of him to turn a forest into a tourist resort. Tan Sri Lim Goh Tong ignored all the negativities and went ahead with his plan although most thought it was really risky and reckoned him who was financially comfortable to be foolish to invest heavily in money and time to develop Genting.
     After Tunku Abdul Rahman, the prime minister of Malaysia visited Genting Highlands and commended Lim's effort to develop a resort contributing to Malaysia's tourism industry without government help, Genting was granted the only casino license. The whole Genting project was completed in January 1971but opened its door for business on 8 May 1971.
          In the next 30 years, Lim continued to develop and expand Genting Highlands beyond its original idea of a hotel with basic tourist facilities. Among the projects were the construction of more hotels, indoor and outdoor theme parks, and a convention centre. In 1993, a township was developed on an 81-hectare piece of land around the site of the Genting Skyway cable car station at the suggestion of Tun Mahathir, the prime minister of Malaysia. It was named Gohtong Jaya after Lim as a token of remembrance for his efforts in the development of Genting Highlands.
As of now, Genting Highlands is one of the most successful Casino resorts in the world and is one of the primary tourist attractions in Malaysia. Lim's company, Genting Group operates Genting Highlands and has diversified into many other industries such as plantations, property, paper, power generation, oil and gas exploration and cruise boat industries.
His eventual success was attributed to his entrepreneurial spirit. "The Genting project fitted my idea of an ideal business," he wrote. "No one was interested in it, which meant no competition." Lim Goh Tong had won many awards together with his company Genting Group for his entrepreneurship and his contribution, among them were Malaysian Entrepreneurs Award 1985, Manager of the Year Award 1986, Business Achiever of the Year Award1994, Number 1 ranking of 10 Malaysian Leading Companies 1999 and The Best Employer Award 1996.
After I read all the three articles about Tan Sri Lim Goh Tong, I found that to become a success entrepreneur, we need to have some of the characteristics. First of all, an entrepreneur must be creative. Just like Lim Goh Tong, he had the idea to develop a hilltop resort when he visited Cameron Highlands. Besides to develop the resort, he designed Genting to become a place suitable for a family trip. The second characteristic I saw from Lim Goh Tong is brave. This can be showed when he had the idea to develop Genting, although many people said that it was really risky and foolish, Lim Goh Tong ignored all the negativities and continue the project and lastly, he was success. Last but not least, an entrepreneur should be innovative. Although Genting is successfully developed but Lim Goh Tong still make innovation on it to become more attractive and involved in more sectors. For example, he get the license of casino, plantations, property, paper, power generation, oil and gas exploration and cruise boat industries.


How BILL GATES Started?

Next, Bill scored 1590 out of 1600 on SAT. He went to Harvard. Only to find himself unsure about where to start – as a pre-law major or as something else? Reading Popular Mechanics one day in college he read an ad about a new computer. He called them to say that he wrote a programming language for it. (He hadn’t.) He asked if they might buy it. He hadn’t even started to write the language. But, he started to be a hustler. And, yes, the computer company was very interested in buying.

Next Bill sat down with his friend Paul from high school, and the two wrote that programming language that he talked about on the phone. Bill wrote 50% of the code, using Harvard’s computers. FaceMash – A Fun Site for Voting

In 2003, once summer evening when Mark Zuckerberg suffered from insomnia in the Harvard dormitory room, he got an idea to create a site called FaceMash. Mark decided to hack the database of Harvard, where the students uploaded their profile pictures. He quickly wrote a program that randomly selected two pictures of two random female students and put them next to each other, asking “Who is hotter?”, giving the option for voting.
The process was in full swing and site was visited by most of the students in Harvard. When the number of visitors exceeded the limit, the server crashed due to overload. Mark appeared before the committee on computer hacking. Of course nobody told Mark Zuckerberg ‘Well done!’ and he received a disciplinary action, and had noticed that such kind of things cause stormy interest in society. By the way, Harvard has refused to comment on the incident up till now.

About ten months before the Zuckerberg’s FaceMash epic, one of the students of Harvard – Divya Narendra – had already spoken with the idea of creating a social network exclusively for Harvard students, many of whom were suffering from emotional stiffness. And not have ‘aliens’ engaged into the network, Narendra suggested using Harvard email address as the main username.
Divya Narendra’s partners were twins Tyler and Cameron Winklevoss. The father of the Winklevoss twins, Howard Winklevoss, is a successful financial consultant and put in his sons a lot of efforts and money – so the problem with the initial capital for the future network could be solved easily.
In conversation with Mark Narendra said that the project would be called Harvard Connection (later renamed to ConnectU), and its members will be posted to the Internet their photos, personal information and useful links. The tasks of Mark Zuckerberg included programming of the site and creating a special source code, which would allow the system to work as quickly as possible.

After a private meeting with Narendra and the Winklevoss twins, Zuckerberg agreed to join in the work, but the potential of his new partners he estimated it skeptically. While working on Harvard Connection he got a fantastic idea about his own social network.
On February 04, 2004 he registered the domain name TheFacebook.com, now known throughout the world as Facebook.com. However, it functioned only within Harvard.
After Zuckerberg and his partner Eduardo Saverin realized that there were already registered 4000 users, they have come to the conclusion that they needed the services of new programmers. One of them was a Mark’s neighbor, Darren Moskowitz, who further opened the Facebook service to students at Columbia University, Stanford, and Yale.

Some time later, the registration was opened to all students. The main condition was the availability of an email address in .edu zone, which also indicated a person’s belonging to education sector.
It must be said that at first this tactic worked out nicely. The project attracted audience attention of sufficient quality. When a user was trying to sign up he had to fill out a detailed profile, and in addition to the email address in .edu zone it was requested to add a real profile picture. If people used avatars instead of real pictures their profiles were deleted.

By 2005, Facebook became accessible for all educational institutions and universities in the USA. Zuckerberg still believed that his project is a social network for students, but the interest of users to Facebook grew exponentially. Then it was decided to make a registration accessible to the public. And after this a Facebook ‘epidemic’ started.

The main thing that immediately attracted users in Facebook, is that friends who meet in real life now could communicate with each other online. It was something new.
Facebook audience grew rapidly, but the monetization of the project still remained unclear. Everyone expected that the main instrument should be context advertising. The fact is that every Facebook user fills sufficiently detailed profile, which can be used to show relevant advertisements. Obviously that would open up enough options to advertisers, who may be of interest to their audience. But Facebook continued  just to build number of users. When they got over 50 million users, large companies began to offer Zuckerberg to sale them the project. So, one time even Yahoo! offered $900 million dollars for Facebook. Lawsuits against Facebook

The Facebook project launch was accompanied by series of scandals. Six days later after launching the site senior students brothers Cameron and Tyler Winklevoss and Divya Narendra accused Mark Zuckerberg in stoling their idea. They claimed that in 2003 hired Zuckerberg to make him complete the establishment of the social network HarvardConnection.com. According to their testimonies, Zuckerberg did not provide them the results of his work, but used the original source code to create Facebook.
In the same year, Narendra and the Winklevoss twins launched their own network renamed to ConnectU. And they continued to attack on Mark Zuckerberg, complaining Harvard administration and The Harvard Crimson newspaper. Initially Zuckerberg urged journalists not to publish the investigation: he showed them what supposedly he did for HarvardConnection, and explained that those developments did not have any relation to Facebook. But very inappropriately, another Harvard student – John Thomson – in personal conversations started saying that Zuckerberg stole one of his ideas for Facebook. The newspaper decided to publish the article and it offended Mark Zuckerberg very much.

Zuckerberg took revenge on The Harvard Crimson. According to Silicon Alley Insider, in 2004, he breaks the mailboxes of two journalists from The Harvard Crimson, using the newly launched Facebook. He found users who were involved in the newspaper and browsed their logs (i.e. history) of incorrectly entered passwords in Facebook. Zuckerberg’s expectations were met: two employees of the newspaper absentmindedly tried to login Facebook with passwords from their mailboxes. Silicon Alley Insider wrote that Zuckerberg got lucky: he had a chance to read the correspondence about him between the editorial office and HarvardConnection.
The Winklevoss twins and Narendra filed a lawsuit against Mark Zuckerberg, but the court rejected their claim. They were persistent and filed another lawsuit. This time the court examined the code sources to understand whether they were actually stolen. But the truth was still not clear. The examination results were not announced. In 2009, Zuckerberg agreed to pay $45 million ($20 million in cash, and the remaining amount in Facebook shares) ConnectU as part of the court settlement. The case was closed. By that time ConnectU had less than 100,000 users, Facebook boasted about 150 million users.
The Winklevoss twins yet did not calm down and filed a petition in the U.S. Court of Appeals, but they were denied a retrial.
